The Board of Directors (the “Board”) of the Harpeth Trace Services Association (“HTSA”) has been working diligently to address road maintenance and improvement issues in our community. As many of you know, as part of this work, the Board engaged specialized legal counsel to analyze the restrictive covenants and other factors applicable to capital projects. The Board recently received a detailed formal legal opinion addressing these issues. The Board has reviewed and accepted the findings of the opinion. Consistent with the conclusions reached by the law firm, the Board has decided to continue to assess owners within our community in a manner consistent with longstanding practice, including by uniformly assessing all of HTSA’s members for the maintenance and repair of roads that are owned and controlled by HTSA, including the roads in Harpeth Trace Estates.The HTSA Board remains committed to fairly and effectively addressing road maintenance and capital improvement issues affecting our neighborhood.
